Privacy Notice under Law No. 6698 on the Protection of Personal Data
This is an informational English translation of our Turkish-language KVKK Privacy Notice, provided under Turkish Law No. 6698. In the event of any discrepancy, the Turkish original is authoritative and governs.
Akdeniz Faktoring Anonim Şirketi (the "Company") takes all technical and legal measures required by Law No. 6698 on the Protection of Personal Data ("KVKK") when processing personal data in connection with its operations. Data subjects can find detailed information below on the processing of their personal data, its transfer to third parties, the legal grounds for collecting personal data, and their rights under the KVKK.
A. Personal Data Processed, Purpose of Processing, Collection Method and Legal Grounds
The legal grounds our Company relies on when processing data are as follows:
- Explicit consent exists (Art. 5/1, Art. 6).
- Expressly provided for by law (Art. 5/2-a).
- Necessary to protect the life or physical integrity of the data subject or another person, where the data subject is physically incapable of giving consent or their consent is not legally valid (Art. 5/2-b).
- Necessary for the processing of personal data belonging to the parties to a contract, provided it is directly related to the establishment or performance of that contract (Art. 5/2-c).
- Necessary for the data controller to fulfil its legal obligations (Art. 5/2-ç).
- The data has been made public by the data subject themselves (Art. 5/2-d).
- Necessary for the establishment, exercise or protection of a right (Art. 5/2-e).
- Necessary for the data controller's legitimate interests, provided this does not harm the data subject's fundamental rights and freedoms (Art. 5/2-f).

B. Transfer of Personal Data
Your personal data processed under the heading above, for the purposes stated there, may — where necessary for carrying out our company's business activities and processes, and limited to what is necessary — be transferred to:
- Audit firms, financial advisors and relevant public institutions and organizations, pursuant to applicable legislation (for conducting activities in compliance with legislation, fulfilling our legal obligations, and managing contract processes),
- Banks and financial institutions (for executing contract processes, financial and accounting operations, and legal follow-up),
- Suppliers and business partners involved in our business processes (for ensuring/auditing business continuity, executing contract processes, following up on requests and complaints, and legal follow-up),
- The relevant supplier company or business partner from which our Company procures services in its business processes (for ensuring/auditing business continuity, executing contract processes, following up on requests and complaints, and legal follow-up),
- Legally authorized public institutions and organizations, in line with and limited to their requests (for conducting activities in compliance with legislation, legal follow-up, and fulfilling our legal obligations under statutory/administrative regulations),
in the manner described above.
C. Rights of the Data Subject
Under Article 11 of the KVKK, everyone has the following rights:
- To learn whether their personal data is being processed,
- To request information if their personal data has been processed,
- To learn the purpose of processing and whether the data is used in accordance with that purpose,
- To know the third parties, domestic or abroad, to whom personal data is transferred,
- To request correction of personal data that has been processed incompletely or incorrectly, and to request that this correction be notified to third parties to whom the personal data has been transferred,
- To request the deletion or destruction of personal data if the reasons requiring its processing no longer exist, despite the data having been processed in accordance with the KVKK and other relevant laws, and to request that this be notified to third parties to whom the personal data has been transferred,
- To object to a result that is to their detriment arising solely from analysis of the processed data through automated systems,
- To request compensation for damages suffered due to unlawful processing of personal data.
Anyone may submit requests regarding these rights to our Company in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller. Requests will be evaluated and concluded free of charge as soon as possible, and no later than thirty (30) days. If the evaluation and decision process requires an additional cost, the fee set out in the tariff determined by the Personal Data Protection Board will apply.
D. Cookies
